Version Date: December 13, 2018. Claude Marsal Parfums (“Company” or “we” or “us” or “our” or “Website”) respects the privacy of its users (“user” or “you”), whether they use our website located at www.claudemarsal.com, including other media forms and media channels related or connected thereto (collectively, the “Website”), to purchase our perfume and related products, or simply register with and/or view the Website. The following Company privacy policy (“Privacy Policy”) is designed to inform you, as a user of the Website, about the types of information that Company may gather about or collect from you in connection with your use of the Website. It also is intended to explain the conditions under which Company uses and discloses that information, and your rights in relation to that information. Each time you use the Website the then-current version of this Privacy Policy will apply. Accordingly, each time you use the Website you should check the date of this Privacy Policy (which appears at the beginning of this document) and review any changes to the Privacy Policy since the last time you used the Website.

The Website is hosted in the United States of America and is subject to U.S. state and federal law. If you are accessing the Website from other jurisdictions, please be advised that you are transferring your personal information to us in the United States, and by using the Website you consent to that transfer and to abide by the applicable laws of applicable states and by U.S. federal law concerning your use of the Website and your agreements with us. SECTION II

Personal Information

While users can view our website by browsing anonymously, we collect identifiable personal information (“Personal Information”) about Website users when they voluntarily provide it in the course of browsing or shopping on the Website, including to make purchases from the Website, voluntarily register or otherwise sign up with the Website, or contact us via the Website. Sites users may provide Personal Information for various reasons, including but not limited to, for the purposes of obtaining newsletters, product information, event information, and services, to answer surveys, enter contests and receive notice of other promotional opportunities, and to make purchases. The type of Personal Information that we may collect includes name, address, phone number, email address and purchase information such as credit or debit card information used to facilitate the sale of perfumes and related products. We may also use the information that you provide to create a personal customer profile in order to let you know of products or events that may be of interest to you, to streamline future purchases, and for customer service purposes, such as following up on customers who have not checked out their abandoned shopping carts or to inquire about their use of the Website. We may combine Personal Information we collect on the Website with other information we otherwise collect online or offline about users to better tailor marketing or website content, including to measure the effectiveness of our advertising, or for other purposes, such as internal research.

In addition, if you choose to participate in Claude Marsal Parfums sponsored social media activities or offerings, including any links to social media services (e.g., plug-ins) on our Website, or if you log into our Website or a portion of our Website through a social media service or similar tool, such as Log in with Facebook or Sign in with Twitter (whether the use of such tools to sign in is optional or mandatory), any information that these third-party social media sites collect as a function of your using those services or sign-in tools is subject to those respective entities’ own privacy policies. In addition, however, if you use those services or sign in to our Website or a portion of our Website using such third-party sign-in tools, certain Personal Information and related information from those third-party websites or services will be shared with Claude Marsal Parfums We will treat this information shared with us in accordance with this Privacy Policy.

Non-Personal And Automatically Collected Information

We automatically collect certain aggregate information and other information when you visit the Claude Marsal Parfums’s website. When in aggregated form, this information does not relate to a single identifiable visitor. It tells us such things as how many users visited the Website and the pages accessed. Collecting this information helps us tailor our Website to our visitors.

Also, we may collect certain non-personal information at the individual level, although it typically is not associated with Personal Information. For example, when you visit the Website to browse, read or download information, we automatically collect standard computer information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses. Cookies: We, our service providers, and third parties such as online network advertisers may collect information using cookies. Cookies are pieces of information that any website may transfer to your browser that are then stored in your computer system. Cookies are returned to the website that deposited them when a visitor returns to that site. Cookies tell us, for example, whether a user is a first-time visitor or has visited the Website before and what areas of the websites are of greatest interest to the user. The deposit of cookies by the Website may enhance your online experience by allowing us to save your preferences for your next visit. Our cookies may also measure the general activity on the Website, which allows us to determine which areas and features are most popular. This information allows us to make improvements to our Website.

A Device Identifier is a number that is automatically assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Sites, help diagnose problems with our servers, analyze trends, track users' web page movements, help identify you and your shopping cart, and gather broad demographic information for aggregate use and we may share this information with third parties for the foregoing purposes.

Device Matching: Data collected from a particular browser or device may be used with another computer or device that is linked to the browser or device on which such data was collected for the purpose of establishing profiles, analytics and delivering ads and/or other content or services to you, across such devices on the Website or on other third party websites or applications that you visit, or it may be transferred to third parties such as online network advertisers for those purposes. For example, we may use the data we receive to determine the probability that a desktop web cookie and a mobile device belong to the same user and may share this device matching information with third parties to enable them to provide advertising, analytics or other services.

Web Beacons: Web beacons, also known as “clear gifs,” “one-pixel gifs,” “web bugs,” “Internet tags” or “pixel tags,” are small graphic images on a website or in an e-mail that allow us and third parties to monitor the activity on the Website or to make cookies more effective. Web beacons allow us, our service providers and other third parties to gauge and enhance the effectiveness of our marketing on our Website or on third party websites or other channels by transmitting information about whether you follow links in our e-mails or Website, or links in third party websites, and by gathering information about the sites you visit before and after visiting our websites. We use log files to store the data that is collected through Web beacons.

Online advertising networks and similar companies that collect information through cookies and similar tools over time and across different websites, including upon or following your visit to our Website, operate on our Sites and utilize cookies, web beacons and similar technologies to collect or receive information from the Website, and from third party websites, and use the information they collect to provide ad measurement services and to target ads to users’ interests. While, as described above, you may have the opportunity to control the use of cookies through your web browser, we do not otherwise currently respond to web browser “do not track” signals or other mechanisms that may offer consumers choice for such activities. If we do so in the future, we will describe how we do so in this Privacy Policy. Security

We incorporate commercially reasonable safeguards to help protect and secure your Personal Information. However, no data transmission over the Internet, mobile networks, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure the security of any information you transmit to us, and you use our Website and provide us with your information at your own risk. When you place orders or access your account information, we use our Secure Sockets Layer (SSL), which encrypts all information you enter before it is sent over the Internet to us.

 

SECTION IV

Children's Privacy

The Sites are not directed to children and we do not intentionally collect or maintain any Personal Information from children under the age of 13 years old. Updating your Personal Information and Opting out of Marketing Communications

If you want to update your Personal Information, you may access your personal profile online, if one exists or is accessible, and change your entry. Generally, any online profile that exists is accessible at the “Fragrance,” “Home” and/or “Online Store” pages by clicking on “Account” or “Login” and entering the applicable information. Otherwise, you may send us an email at marketing@claudemarsal.com for assistance in updating your Personal Information.

You may choose to unsubscribe from marketing emails by sending an email to marketing@claudemarsal.com or by utilizing the unsubscribe link on our marketing emails. Please note that any requests may take up to six to eight weeks to become effective. If you choose to opt-out not only of emails, but all other forms of marketing communications as well, please contact us at marketing@claudemarsal.com.

Even if you opt-out of marketing communications, we may still contact you to send you important information regarding the operation or administration of your personal profile or other non-marketing information. SECTION VI

BigCommerce

Our store is hosted on BigCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through BigCommerce’s data storage, databases and the general BigCommerce application. They store your data on a secure server behind a firewall.

Payment: If you choose a direct payment gateway to complete your purchase, then BigCommerce stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your credit card information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Changes to this Privacy Policy

We reserve the right, in our sole discretion, to modify, alter or otherwise update this policy at any time and you agree to be bound by such modifications, alterations or updates. We will notify you of material changes to this Privacy Policy by posting the revised policy with the date it was revised on this page and if you have registered with us, we may notify you by email to your email address of record. Your continued use (including access, browsing and/or use of any interactive feature) of our Sites constitutes your agreement to this Privacy Policy and any updates. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the Personal Information we collect.

California Privacy Rights

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to have a right to obtain a list of Personal Information that we may have disclosed to affiliates for their marketing purposes or to unaffiliated third parties for their own marketing purposes. A California customer may contact us and request the general list of Personal Information shared and the companies among which it is shared. This request may be sent electronically by email to marketing@claudemarsal.com We will respond to these requests for the list within 30 days. Requests for this information that come to us through other channels may result in a delayed response.

Intellectual Property Rights

You may not access or use the Website for any other purpose other than that for which Company makes it available. The Website is for the personal use of users only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Company. All Company graphics, logos, designs, page headers, button icons, scripts and service names are registered trademarks, common law trademarks or trade dress of Company in the U.S. and/or other countries. Company's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Company. The Company Content on the Website is provided to you “AS IS” for your information and personal non-commercial use only, may not be used other than in connection with purchases from the Website for your personal non-commercial use, and may not be copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purposes whatsoever, without the prior written consent of the Company. Systematic retrieval of data or other content from the Website to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from Company is prohibited. Claude Marsal Parfums wants you to be aware that when you click on links and/or ad banners that take you to affiliated or third-party web sites, you will be subject to the privacy policies and terms of use for those websites, not ours. We encourage you to read the posted privacy statement and user terms whenever using, and prior to providing any personal information to, any other website.

The Website may contain content that is supplied by a third party, and those third parties may collect Usage Information and your Device Identifier when pages from the Site are served to you.  In addition, when you are on the Website you may be directed to other services that are operated and controlled by third parties that we do not control.  We are not responsible for the data collection and privacy practices employed by any of these third parties or their services and they may be tracking you across multiple sites and may be sharing the results of that tracking with us and/or others.

EU Citizens Only:  Our Compliance with the General Data Protection Regulation

We respect and safeguard the data privacy rights of all of our website visitors and customers.  The European Union (“EU”) has enacted the General Data Protection Regulation (“GDPR”), which requires additional protections for the Personal Information of EU citizens.  The definition of Personal Information for EU citizens is broader than the definition set forth in this Privacy Policy – it can also include IP addresses, responses to surveys, social media identifiers and photographs posted to social media.  EU citizens also enjoy additional protections under the GDPR.  For this reason, our Privacy Policy as it applies to EU citizens, effective October 26, 2018.  Below we set forth how we are satisfying the GDPR requirements for our EU citizen users.

We only share your Personal Information with our business partners for the lawful purpose of digital marketing, and we ensure any third parties receiving your Personal Information comply with the requirements of the GDPR.  If you provide us with social media details, we may obtain publicly available information about you from these social media platforms.  We will obtain consent from you for any uses of your Personal Information that fall outside the purpose described in this Privacy Policy. We do not collect sensitive information about you.  

3. Retention of Personal Information

Your Personal Information will be retained by us for no longer than is necessary to fulfill the purpose for which it was collected, or as if required by law. When your Personal Information is deleted, it shall be deleted across all of our platforms and no longer shared with our business partners.
